TRIBUNNEWS.COM, JAKARTA – Researcher at the Association for Elections and Democracy (Perludem), Heroik Pratama, revealed that the constellation of the 2024 regional elections has changed significantly after the Constitutional Court (MK) ruling on the Pilkada Law.

Based on the Constitutional Court’s decision Number 60/PUU-XXII/2024, the registration requirements for regional head elections are now based on the number of Permanent Voters List (DPT), replacing the old requirement that requires 20 percent of DPRD seats.

This change has had an impact on political dynamics in several regions.

In South Tangerang, for example, PKS, which initially supported Ahmad Riza Patria and Marcel Widianto, has now switched to supporting its own cadres, Ruhamaben-Shinta, for the Tangsel Pilkada.

In addition, Airin Rachmi Diany, who was previously not supported by her party, Golkar, to run in the Banten governor election, can now continue her candidacy with the support of PDIP.

“If we look at the Constitutional Court’s decision, it becomes a new gap in our contestation in facilitating political parties in registering their candidate pairs. So far, political parties have been shackled by the rule of 20 percent of DPRD seats,” Heroik told Tribunnews.com, Tuesday (27/8/2024).

He continued that the Constitutional Court’s decision was an oasis in the journey of Indonesian democracy which is expected to be far more democratic. This means that the barrier for candidates to enter the contestation of regional head elections has become easier.

“That’s why in Banten, Tangerang changed. And I think this will also change in other regions,” he explained.

He explained that if there are concerns about political parties proposing their own candidates, it is not by coalition.

According to him, political party coalitions can still be formed after the 2024 elections to support the running of the government in the regions.

“Coalitions can still be built after the Pilkada. So I think this is a good aspect in our elections, voters can be given alternative choices,” he said.

In the Constitutional Court’s decision Number 60/PUU-XXII/2024, it is stipulated that for the Governor election, political parties need a percentage of valid votes in the previous Legislative Election (Pileg) in accordance with the number of DPT as follows:

  • DPT 2 million: 10% of valid votes
  • DPT 2 million to 6 million: 8.5% of valid votes
  • DPT 6 million to 12 million: 7.5% of valid votes
  • DPT more than 12 million: 6.5% of valid votes

Meanwhile, for Regent or Mayor elections:

  • DPT 250 thousand: 10% of valid votes
  • DPT 250 thousand to 500 thousand: 8.5% of valid votes
  • DPT 500 thousand to 1 million: 7.5% of valid votes
  • DPT more than 1 million: 6.5% of valid votes
