TEMPO.CO, Jakarta – Member of the Board of Trustees of the Association for Elections and Democracy (Perludem) Titi Anggraini said that the interim replacement (PAW) of the General Election Commission (KPU) commissioners should not take long. She made this statement in response to the process of dismissing KPU Chair Hasyim Asy’ari, which is currently being carried out by President Joko Widodo or Jokowi through a Presidential Decree (Keppres).
Titi reminded that the process of issuing a Presidential Decree on Hasyim’s dismissal must be carried out a maximum of 7 days after the decision of the Election Organizer Honor Council (DKPP) was read out last Wednesday.
“It should not take long, there should be an immediate appointment and inauguration of new KPU members,” Titi said when met in Central Jakarta, Saturday, July 6, 2024.
Titi explained that actually the candidate to replace Hasyim was already known. According to her, the new KPU member is a figure with the next order after the 7 commissioners who have been appointed have served. However, because the figure in the 8th order, Viryan Azis, has died, the person who might replace Hasyim is Iffa Rosita.
Therefore, Titi said, Jokowi must be consistent with the results of the fit and proper test which shows that Iffa Rosita is the new KPU commissioner. If there are no extraordinary obstacles, Titi explained, the replacement of KPU commissioners only takes a maximum of one month.
“In fact, in my opinion, in a matter of weeks it should be finished,” he said.
The guest lecturer at the Faculty of Law at the University of Indonesia (FH UI) urged the president and the DPR to immediately resolve the issue of replacing KPU commissioners. She reminded that the upcoming Regional Head Elections or Simultaneous Regional Elections need to be handled by a complete number of KPU commissioners.
Titi explained that if the KPU commissioners have returned to 7 people, it is necessary to determine who the chairman of the KPU is. She emphasized that the chairman of the KPU plays an important role in institutional work, such as the issuance of KPU Regulations (PKPU) to the consolidation of regional elections.
“Although the acting chairman of the KPU can perform the same tasks, this is a matter of institutional legitimacy,” she said.
Not only that, Titi also explained that basically there was no prohibition for the six commissioners to elect a defunct KPU chairman earlier. However, the ideal condition requires the election of the definitive KPU chairman when the number of commissioners is complete with 7 people.
Previously, the Presidential Palace stated that Jokowi was processing a presidential decree (Keppres) for the dismissal of Hasyim Asy’ari as KPU Chairman. The dismissal was carried out after the DKPP verdict which stated that Hasyim violated the code of ethics for sexual harassment.
Presidential Special Staff Coordinator Ari Dwipayana said the Jokowi administration appreciated DKPP’s move as an institution authorized to handle violations of the code of ethics of election organizers.
“Regarding the sanction of permanent dismissal for KPU Chairman Hasyim Asy’ari by DKPP, it will be followed up with the issuance of a Presidential Decree,” he said via text message to Tempo, Wednesday evening, July 3, 2024.
The Palace processes the Presidential Decree on Hasyim’s dismissal within seven days after the DKPP verdict is read. “Currently, the Government / Ministry of State Secretariat is still waiting for a copy of the DKPP decision,” he said.
