REPUBLIKA.CO.ID, JAKARTA – The Association for Elections and Democracy (Perludem) noted that there was an increase in the number of 2024 general election result dispute (PHPU) applications to the Constitutional Court (MK) compared to the 2019 elections. In fact, the 2024 election is the second simultaneous election held in Indonesia.
Perludem researcher Ihsan Maulana said, based on data compiled from the Constitutional Court’s website until Monday (25/3/2024), there had been 277 PHPU cases registered. The 277 cases consisted of two presidential election cases (pilpres), 263 legislative elections (pileg) for the DPR or provincial and district / city DPRDs, and 12 DPD elections.
“Compared to 2019, there has been an increase in cases entering the Constitutional Court. In 2019 there were only 261 cases, in 2024 as of today there are 277 cases,” he said during an online discussion on Monday.
According to him, this shows that the implementation of the election is still characterized by allegations of fraud, violations, which have an impact on the election results. As a result, election participants filed a PHPU lawsuit to the Constitutional Court.
Ihsan assessed that this was an unfavorable signal, considering that the 2024 Election was the second simultaneous election. Supposedly, if election organizers can learn from the implementation of the elections five years ago and succeed in mitigating risks, PHPU cases can decrease.
“That is indeed the right of election participants. But there is still an increasing trend. PHPU should not be as much as today,” he said.
Meanwhile, Chairman of the General Election Commission (KPU) Hasyim Asy’ari said that for the 2019 PHPU case, the Constitutional Court received 340 cases. The 340 cases consisted of 329 DPR / DPRD cases, 10 DPD cases, and one presidential election case.
However, not all of these requests were registered by the Constitutional Court. In the 2019 PHPU process, there were only 260 cases that continued examination from a total of 340 cases registered.
“Of the total 260 cases (2019 election), the Constitutional Court only continued 122 cases that advanced to the main hearing stage,” he said, Sunday (3/24/2024).
According to Hasyim, the Constitutional Court handled 260 cases of disputes over the DPR, DPRD and DPD or Pileg votes that were registered. Of the 260 cases, the Constitutional Court only granted 12 cases.
“PHPU cases rejected by the Constitutional Court (in 2019) were 106 cases or 41 percent, and 99 cases or 38 percent of cases were inadmissible 33 cases or 13 percent, and 10 cases or 4 percent were withdrawn,” he said.
