The handling of the 2024 General Election Results Dispute (PHPU) case by the Constitutional Court (MK) is considered by the Association for Elections and Democracy (Perludem) to be not optimal, because there are facts that have not been revealed.
Perludem Executive Director Khoirunnisa Nur Agustiyanti revealed, the veil of shortcomings that exist in the Constitutional Court can be seen from the dissenting opinion on the dispute over the results of the 2024 presidential election (Pilpres).
“For example about social assistance (bansos). Actually, there are 3 judges who have different views (dissenting opinion). These three judges are convinced that there are problematic practices,” said Khorunnisa in an election evaluation discussion in the Cikini area, Menteng, Central Jakarta, Friday (7/6).
The figure who is often called Ninis explained, on the other hand, Constitutional Judges Saldi Isra, Enny Nurbaningsih, and Arief Hidayat, who were the three Constitutional Judges who delivered dissenting opinions, revealed the shortcomings of the Constitutional Court in handling PHPU.
“The Constitutional Court refused because it was not convinced by the evidence presented by the petitioners. But on the other hand, the Constitutional Court said that the process was very short, only 14 days,” she explained.
Because there is a time-limited authority of the Constitutional Court, Ninis further revealed that the argument regarding the alleged politicization of social assistance raised in the dispute over the results of the 2024 Presidential Election was indirectly considered by the Constitutional Court.
“So if we read the legal considerations of the Constitutional Court, it actually says that related to social assistance, there is indeed an indication of the absence of presidential anticipation, that by providing social assistance during visits to the regions, it will create a sense of unfairness in organizing elections,” Ninis added.
